Preamble

This personal data protection policy (hereinafter the “Policy”), implemented by RM CROISIERES, is intended to provide Users with summary and global information on the collection and Processing of personal Data carried out on the site www.rmcroisieres.com (hereinafter the “Site”), by GROUPEMENT RM CROISIERES, public limited company with share capital of XXeuros, registered in the SIRENE directory under number 847 686 342 and registered in the Trade and Companies Register of FORT DE FRANCE, whose head office is located at the Marina du Marin (97290) – MARTINIQUE, having as its object the combined administrative office management. In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing the directive 95/46/EC (the “GDPR”).

This applicable Policy is the one in force on the date of consultation of the Site and until a new version replaces them.

This Policy may be modified by RM CRISIERES at any time and without notice.

By consulting the Site, the User acknowledges having read this Policy and agrees to comply with it without reservation.

Article 1 – Definitions

The terms used in this Policy and beginning with a capital letter, if they are not defined in this article, will have the meaning given to them in the Terms of Use of the Site.

“Personal Data”: means any information relating to an identified or identifiable natural person; is deemed to be an “identifiable natural person” a natural person who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, an online identifier, or to one or more specific elements specific to his physical, physiological, genetic, psychological, economic, cultural or social identity.

“Policy”: refers to this personal data protection policy, applicable to the Processing of Personal Data of Users of the Site.

“Processing”: means any operation, or set of operations, relating to such data, regardless of the process used (collection, recording, organization, storage, adaptation, modification, extraction, consultation, use, communication by transmission, dissemination or any other form of provision, reconciliation or interconnection, blocking, erasure or destruction, etc.).

“Controller”: means the person who determines the purposes and means of the Processing of Personal Data.

Article 2 – Data controller

The Data Controller for the Processing implemented via the Site is:

RM CRUISES.

Article 3 – Collection and origin of Personal Data

RM CROISIERES is likely to collect the User’s Personal Data directly (in particular via the collection forms available on the Site).

RM CROISIERES undertakes to obtain the User’s consent and/or allow him to object to the use of Personal Data for certain purposes, as soon as necessary.

In all cases, the User is informed of the purposes for which his Personal Data is collected via the various Personal Data collection forms.

Article 4 – Personal Data collected

The User’s Personal Data that may be collected on the Site and processed by the Data Controller are as follows:

– Last name and first names) ;

– Address ;

– E-mail address ;

– Telephone number;

– Any other Personal Data communicated by the User to RM CROISIERES.

The Personal Data identified by an asterisk in the collection forms are mandatory because they are necessary to take into account the request made. If this mandatory information is not provided, these operations cannot be taken into account.

Personal Data relating to Users which are made accessible on the Site cannot be collected and processed without the prior written consent of the person concerned, in accordance with these Terms.

Article 5 – Purposes of Personal Data Processing

RM CROISIERES uses the Personal Data of Users of the Site, in particular for the following purposes:

– respond to User requests, such as information, research, newsletters or other content;

– propose offers to Users relating to the products that RM CROISIERES markets and/or those of its partners;

– personalize and improve the User’s experience on the Site;

– any other purpose that RM CRISIERES would specify, if necessary, at the time of the collection of the User’s Personal Data.

Article 6 – Legal Basis for the Processing of Personal Data

RM CROISIERES processes Users’ Personal Data in the context of the execution and management of their contractual relationship, its legitimate interest in improving the quality and operational excellence of the services offered on the Site or in respect of certain regulatory obligations.

The processing of Personal Data may also be carried out on the basis of the prior consent of the User in the event that this is, in certain situations, requested.

Article 7 – Communication of Personal Data

RM CRISIERES restricts access to Personal Data only to members of its staff who need to know it in order to process the User’s request or provide the requested Service.

RM CROISIERES does not disclose Personal Data to unauthorized third parties.

RM CROISIERES may, however, share Personal Data with its subsidiaries and/or its holding company as well as its authorized service providers (for example: technical service providers (publishing, hosting, maintenance of the Site), consultants, etc.) to which RM CROISIERES makes call for the sole purpose of making the Site available.

RM CROISIERES does not authorize these service providers to use or disclose Personal Data, except to the extent necessary to perform the Services on behalf of the User or comply with legal obligations. In addition, RM CROISIERES may share Personal Data (i) if the law or legal process requires it to do so, (ii) in response to a request from public authorities or other officials, or (iii) if the RM CROISIERES considers that the transmission of this Personal Data is necessary or appropriate to prevent physical harm or financial loss, or in connection with an investigation into suspected or proven illegal activity.

Article 8 – Transfer of personal data

Due to the global nature of our organization and our Services, Personal Data may be stored and/or processed in a country other than that in which the User resides.

Some of the non-EEA countries are recognized by the European Commission as providing an adequate level of data protection according to EEA standards (the full list of these countries is available here).

For transfers from the EEA to countries which are not considered adequate by the European Commission, RM CROISIERES has put in place adequate measures, in particular through contractual agreements put in place with third parties.

Article 8 – Duration of retention of Personal Data

RM CROISIERES retains Personal Data for a period that does not exceed the period necessary for the purposes for which they are collected and processed, a period which is extended, if necessary, by the durations of applicable legal or regulatory requirements.

Thus, RM CROISIERES retains the User’s Personal Data for a period of:

– three (3) years from their communication to RM CROISIERES by the User;

– Thirteen (13) months from their implementation regarding cookies.

The retention periods may be interrupted in the event of the exercise of rights, as provided for in this Policy.

Article 9 – Rights of Users regarding their Personal Data

In accordance with the GDPR, the User has certain rights relating to the processing of his Personal Data. In the event of exercising one or more rights relating to the processing of his Personal Data, the User is informed that he could lose access to the Site and the use of the Services.

Right of access: the User may request access to his Personal Data and request the rectification of Personal Data that is inaccurate or that incomplete data be completed.

The User also has the right to know the sources of this Personal Data.

Right to deletion: the right to be forgotten entitles the User to request the deletion of their Personal Data when:

(i) the Personal Data is no longer necessary for the fulfillment of the purposes for which it was collected and processed;

(ii) the User chooses to withdraw his consent (when his consent has been collected as the legal basis for the processing), this withdrawal not affecting the lawfulness of the processing before its implementation;

(iii) the User objects to the Processing;

(iv) the Personal Data has been unlawfully processed;

(v) the Personal Data needs to be erased to comply with a legal obligation; Where

(vi) their deletion is required to ensure compliance with the GDPR.

Right to limitation: the User may also request the limitation of the processing of his Personal Data if:

(i) the User disputes the accuracy of the Personal Data;

(ii) RM CROISIERES no longer needs such Personal Data for the purposes of the Processing; and

(iii) the User has objected to the Processing of Personal Data.

Right to object to direct prospecting messages: the User may at any time ask RM CROISIERES to no longer receive advertisements or prospecting by contacting him directly and free of charge, or by means of the unsubscribe link included in any prospecting that RM CROISIERES may contact the User by e-mail or by sending an e-mail to the address indicated below. This opposition is without prejudice to the legality of the shipments made before its implementation.

Right not to be the subject of a decision based exclusively on automated Processing of Personal Data: the User has the option not to be the subject of a decision based exclusively on automated Processing producing effects legal matters concerning or significantly affecting him.

Right to portability: the User may ask RM CROISIERES to provide him with his Personal Data in a structured, commonly used, machine-readable format.

Right to issue advance directives on the processing of Personal Data after his death: The user can define directives on the use of his Personal Data after his death (in particular on their retention period, their deletion and /or their communication) as well as to designate a person in charge of the exercise of these rights.

Right to lodge a complaint with a supervisory authority: if the User has concerns or complaints regarding the protection of his Personal Data, he has a right to lodge a complaint with the National Commission for Computing and Liberties via the following link: www.cnil.fr.

However, the User is requested to send any request to RM CROISIERES beforehand by contacting it at the address indicated below so that it can process the User’s request and find an amicable solution.

To exercise these rights, the User may make his request by email to the following address: rmcroisieres@live.fr. Each request must be accompanied by a photocopy of an identity document bearing the User’s signature and specify the address to which RM CROISIERES must respond. The response to the request will be sent to the User within a maximum period of two (2) months from the receipt of the request by RM CROISIERES.

Article 11 – Cookies

When consulting this Site, certain information relating to the User’s browsing may be recorded in so-called “Cookies” files installed on their terminal (computer, tablet, mobile phone or any other device optimized for using the Internet ). These cookies are issued by RM CROISIERES in order to best meet the expectations of the User and facilitate his navigation on the Site.

11.1. What is a cookie ?

A cookie is a text file which, thanks to your navigation software, is placed in a dedicated space on the hard drive of the User’s terminal when visiting a site or consulting an advertisement. RM CROISIERES implements all technical and organizational measures to ensure the security and confidentiality of the Processing of Users’ personal Data.

As such, RM CROISIERES takes all necessary precautions, with regard to the nature of the Personal Data and the risks presented by the Processing, in order to preserve the security of the data and, in particular, to prevent them from being distorted, damaged or that unauthorized third parties have access to it (physical protection of the premises, authentication processes with personal and secure access via confidential identifiers and passwords, logging of connections, encryption of certain data, etc.).
